A tragedy that broke out on May 24 is now leading to a class-action lawsuit where victims of the Uvalde mass shooting seek damages for ongoing traumas. The shocking amount of the lawsuit follows that this is among the ten worst mass shooting incidents in the United States.
The Robb Elementary school massacre in Uvalde, Texas, was responsible for 21 fatalities and 17 injuries, per Statista. Two teachers were killed, while 19 students lost their lives during this incident. Compared to other mass shootings, this incident was ranked the 8th worst.
The absolute worst mass shooting incident was the Las Vegas Strip massacre, where 58 people lost their lives while 546 people were injured. However, this incident wasn't the same as the Robb Elementary school massacre, where the victims, aside from the two teachers, were aged 9 to 11.
The class-action lawsuit indicates that the subjects failed to follow the protocols for handling that situation.
The $27 billion suit stretches out to many entities within the city of Uvalde, including the city itself, the school district, the police department, and several police and school personnel.
The class-action lawsuit seeks damages for ongoing trauma for the victims, families of the victims, and the kids that witnessed the massacre. It was launched in the US District Court for the Western District of Texas against an array of public entities and officials.
In another lawsuit, District Attorney Christina Mitchell was sued by the city of Uvalde for failure to hand over shooting-related investigative materials.
Attorney Charles Bonner, whose law firm in California brought the suit, said they were also working on a separate suit filed by Everytown against the same defendants and the maker of the AR-15-style firearm, Daniel Defense.
Per Bloomberg Law, a 2005 act of Congress called the Protection of Lawful Commerce in Arms Act (PLCAA) granted gun manufacturers broad immunity from gun crime-related lawsuits. However, recent legal developments like the Sandy Hook case showed exceptions like how the marketing by the gun company violated state law on advertising and consumer protection.
